SUMMARY:

The Litigation Counsel is responsible for all in-house litigation, including all commercial, construction, and administrative (DEP, EHB, OSHA) claims.  The Litigation Counsel will also be responsible for all mediation, arbitration, and settlement negotiations. The Litigation Counsel shall possess a degree from an accredited Law School and shall be licensed to practice law in the Commonwealth of Pennsylvania.

DUTIES AND RESPONSIBILITIES:

  • Provide legal advice and risk management through all phases of construction, including bidding, project completion, and close out;
  • Provide legal guidance regarding change order disputes and potential delay claims;
  • Represent and/or oversee the representation of the Corporation in all commercial and construction arbitration, litigation, and bond/insurance claims;
  • Initiate and defend collection actions;
  • Coordinate and oversee activities of outside counsel;
  • Assist in the development of the corporations’ business plan;
  • Oversee Safety Director in implementing safety compliance;
  • Assist and advise on all legal matters for all projects as directed by the CEO and/or Board of Directors;
  • Assist Corporate Counsel with corporate governance, human resources, and compliance issues.

KNOWLEDGE, SKILLS, AND ABILITIES REQUIRED:

  • Mediation and jury trial experience;
  • Organizational skills in order to coordinate tasks with all departments;
  • Ability to oversee projects and employees;
  • Sufficient knowledge of Microsoft Word and Excel;
  • Excellent knowledge of mechanical contracting industry with proven ability to read and interpret construction plans and specifications;
  • Experience negotiating change orders and delay claims;
  • Excellent presentation skills;
  • Strong interpersonal and communication skills and the ability to work effectively with a wide range of diverse individuals; and
  • Ability to enforce all Tomko rules and procedures.

MINIMUM EXPERIENCE:

Minimum of 7 years of experience as a lawyer representing clients in the mechanical contracting industry.

WORKING CONDITIONS:

Pleasant and safe working atmosphere and conditions, which at times, may involve moderate exposure to unusual elements, such as extreme temperatures, dirt, dust, fumes, smoke, unpleasant odors, and/or loud noises.

PHYSICAL EFFORT:

Light physical effort, requires handling of average-weight objects up to 15 pounds and some standing and walking.

ENVIRONMENTAL CONDITIONS:

Pleasant and safe working atmosphere and environment, which at times, may involve the exposure to hazards or physical risks, which require basic safety precautions enforced by OSHA and/or W.G. Tomko, Inc.

QUALIFICATIONS:

  • Member of the California Bar in good standing.
  • Strong academic credentials preferred.
  • Experience with healthcare companies preferred.
  • 7-10 years prior experience with litigation at a law firm or inhouse counsel department.
  • Excellent reading, oral/written communication skills, negotiation skills and concise grammatical skills.
  • Strong work ethic with a positive, can-do attitude.
  • Strong initiative and ability to manage multiple projects as well as strong follow through skills.

JOB RESPONSIBILITIES:

  • Provide day to day advice on a broad range of employment issues, including recruiting, hiring, compensation and benefits, wage and hour, HR practices, performance management, terminations, and labor relations.
  • Oversee employment and workers compensation litigation, including developing relationships, managing costs, and coordination with company witnesses.
  • Oversee the internal and external investigations of complaints concerning violations of company policies, laws, and regulations.
  • Handling and responding to 3rd party subpoenas for employee records.
  • Participate in employment matters related to Corporate led transactions, including due diligence and integration.
  • Drafting and/or reviewing responses to various state and federal government agencies.
  • Help build and implement scalable, standard employment policies and programs that balance legal risk with business impact.
  • Work with the company’s HR teams to handle and support compliance, employee issues, internal investigations, audits, pre-dispute conflicts, employment law claims, and arbitrations.
  • Draft, review, analyze, and negotiate employment-related agreements, including consulting, severance, incentive, non-compete, and confidentiality agreements.
  • Establish a rapport and working relationship with employees at all levels in order to act as a trusted advisor and encourage the proactive use of in-house legal counsel as a preventative measure for human resources issues.
